New rules will restrict building in North Raleigh and Wake Forest due to state mandates on the watershed areas. This does not only apply to new construction, but also applies to existing homes. New environmental rules are about to be implemented making it more difficult to add a deck or build an addition or even, add a shed to your property.
The communities of Wakefield Plantation, Bedford at Falls River, and Falls River are among the many neighborhoods that would be affected by these new rules. A major proposal to restrict development on 5,000 acres to protect a possible, future source of drinking water could determine if you could build that shed or pool that you always dreamed of having.
The affected area generally consists of all land from Durant Road to Wakefield Plantation, between Falls of Neuse Road and Capital Blvd. Wake Forest and Wake County had already set these regulations to meet the state’s requirement for these watershed areas back in 2005. Now, Raleigh must follow suit or risk large fines being levied against the city of as much as $10,000 a month.
The city failed to convince the state environmental regulators that these new restrictions are not needed, so it must comply. The resulting rules will affect more than 7,300 property owners and many more to move into these desired areas. Many of the property owners are not aware of the rezoning as the city will begin to notify them in the next few weeks.
The new rules will protect the spot where the former Burlington Mills once pulled water to dye fabrics. At this time, the water is not being used for drinking water, though Franklin County is interested. In 2004, the state sent a directive to control development in the watershed so the water from the pipe would be clean enough to be treated for drinking water, should anyone wish to use it.
The new rules will require that any property that uses more than 24% of the land with hard surfaces, such as homes, decks, driveways, etc. have devices or landscaping in place to catch the first inch of rain that runs off the surface. Many current homes would be in violation of this new rule and may be required by the city to comply.
The affect on future use would be similar in that the city would have to be advised if the addition would make the land use of the individual lot more than the 24% threshold. If a homeowner wanted to make an addition that would put them over the limit, they would have to comply with the new standards. The public hearing is scheduled for Jan. 22 before the City Council and Planning Commission at 6:30.

As Chair of the Philanthropy Committee, he was a Team Captain for the Susan G. Komen Race for the Cure and volunteered for the Jimmy V Celebrity Golf. He has also served on the planning committee for the Big Bad Ball, which is a black tie event that raises much needed funds for the Hospice of Wake County. Additionally, he coaches youth basketball and sponsors a YMCA basketball team. He feels that it is very important to give back to the community.
